This is the biggest but most important part of the site so please ensure you read this carefully and absorb all Trevor’s tips.

The chances are that nearly all witnesses feel nervous. They may worry about speaking clearly, sounding convincing, being made to look stupid, losing credibility and being intimidated. Of course, that is the aim of the barrister who will cross-examine you, whose goal it is to make you and your evidence look worthless or unreliable

Preparation is key to reducing anxiety to manageable levels and the key to giving evidence is unsurprisingly; preparation, preparation, preparation. This will enable you to feel and sound confident when giving evidence in Court.

The single most important point is to read and check your witness statement and any written evidence you have provided, and ask yourself the following questions:

  • Have the facts changed since making your Statement?
  • What has changed and has it altered your views in any way?
  • If evidence has arisen since your statement which has caused you to change your views, then write down how this has changed and be sure to discuss this with your instructing solicitor either before, or when you arrive at court/tribunal if unable to do so before.
  • Does your statement flow, is it consistent, is it true and above all will you be able to orally deliver that which you have written?

Once you are confident with your evidence ask yourself:

  • What is the weakness in my evidence?
  • What questions could be asked when I am examined?
  • What is the cross-examining barrister likely to home in on?

Think it through and write down how you intend to respond to each point. If you think there may be a weakness, for example, then prepare a reason for that weakness as when you give evidence this will show you are a reasonable person. Courts/tribunals like reasonableness.

Then re-read your statement and your answers again so that you are completely confident.

If you feel unsure it is important that you speak with your solicitor immediately.
